Finally , the employer should consider whether it wishes to adopt an alternative dispute resolution process.
In recent years, courts and the legislatures have encouraged adoption of such procedures rather than costly litigation. However, in order to be effective, such procedures must meet certain criteria of fairness.
For this reason, before adopting such a procedure, the employer should consider the relative strengths and weaknesses of such a valid ADR procedure.
