The problem is that this approach causes management of human resources to be, essentially, adversarial.
The results of this adversarial based workplace are:
- Managers have become afraid to make personnel decisions for fear of being sued.
- Employers pay exorbitant legal fees to litigate disputes which should have been resolved through a progressive Employee Relations Program.
- "I'll sue!!" is employees' answer to every personnel action by management
